These Terms and Conditions govern the provision of rubbish removal and related waste collection services by Rubbish Removal Belgravia to you as a customer. By booking any service, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking or using our services.
In these Terms and Conditions, the following definitions apply:
1.1 "Company" means Rubbish Removal Belgravia, the provider of waste collection and rubbish removal services.
1.2 "Customer" or "you" means any individual, business, landlord, tenant or organisation that requests or receives services from the Company.
1.3 "Services" means rubbish removal, waste collection, bulky waste removal, clearance, recycling, and any related services provided by the Company.
1.4 "Booking" means a confirmed request for Services made by the Customer via phone, email, online form, or any other approved communication channel.
1.5 "Waste" means any items, materials, rubbish or refuse to be removed under the Services, excluding any prohibited, hazardous, restricted or special waste.
2.1 The Company provides domestic and commercial rubbish removal and waste collection services, including but not limited to household clearances, garden waste removal, office clearances, and general junk removal.
2.2 The Company will use reasonable care and skill in providing the Services and will endeavour to complete each job efficiently and safely in accordance with applicable UK waste regulations.
2.3 The exact scope of the Services for each Booking, including the type and approximate volume of Waste to be collected, will be agreed between the Company and the Customer prior to the commencement of the job.
3.1 A Booking may be made by contacting the Company via telephone, email or booking form and providing accurate information about the property, access, parking and the nature and volume of the Waste.
3.2 Any quotation given prior to arrival at the property is based on the Customer's description of the Waste and site conditions and is indicative only. The final price will be confirmed on site once the Company has inspected the Waste.
3.3 A Booking is accepted and a contract is formed when the Customer confirms acceptance of the quotation and the Company confirms the appointment time and date. Confirmation may be given verbally or in writing.
3.4 The Customer is responsible for ensuring that the contact details and service address supplied are correct and that someone is available to grant access at the agreed time.
3.5 The Company reserves the right to refuse or cancel any Booking where the Waste is unsuitable, access is unsafe, or the Services requested fall outside the Company’s normal operations or regulatory permissions.
4.1 The Customer must ensure that the Company’s team has safe, free and reasonable access to the Waste at the agreed time. This includes providing any necessary keys, codes, permits, or permissions for entry.
4.2 The Customer is responsible for arranging suitable parking or for covering any parking charges, congestion charges, tolls or similar costs reasonably incurred in providing the Services.
4.3 If access to the property or Waste is obstructed, hazardous or significantly different from the description provided at the time of Booking, the Company may:
a) revise the quotation to reflect any additional time or labour required; or
b) refuse to carry out some or all of the Services and treat the visit as a chargeable call-out.
4.4 The Customer must ensure that the site is reasonably safe and that any known risks are disclosed to the Company in advance.
5.1 Prices are generally based on the volume and nature of the Waste, the time required and any special handling or disposal requirements. The Company will provide a quotation before commencing work.
5.2 Unless otherwise agreed in writing, payment is due in full on completion of the Services on the day of collection.
5.3 The Company accepts payment by cash, major debit or credit card, and other agreed payment methods. The Customer must ensure that sufficient funds are available.
5.4 All prices quoted are exclusive of any applicable taxes unless otherwise stated. Where applicable, VAT or other taxes will be charged at the prevailing rate.
5.5 If the Customer fails to pay any amount due, the Company reserves the right to charge reasonable late payment fees and interest in accordance with applicable UK law and to recover all costs of collection.
6.1 The Customer may cancel or amend a Booking by contacting the Company during normal working hours.
6.2 If the Customer cancels a Booking more than 24 hours before the scheduled appointment time, no cancellation fee will normally be charged.
6.3 If the Customer cancels a Booking less than 24 hours before the scheduled appointment time, or fails to provide access when the team arrives, the Company reserves the right to charge a reasonable cancellation or call-out fee to cover its costs.
6.4 The Company may cancel or reschedule a Booking due to operational reasons, adverse weather, staff illness, vehicle breakdown, or where it is not safe or lawful to carry out the Services. In such cases, the Company will notify the Customer as soon as reasonably practicable and will offer an alternative appointment. The Company will not be liable for any indirect loss arising from such cancellation or rescheduling.
7.1 The Customer must:
a) Provide accurate information about the type and quantity of Waste.
b) Inform the Company of any hazardous, sharp, heavy or awkward items.
d) Comply with any reasonable instructions issued by the Company’s team on site.
7.2 The Customer warrants that they either own the Waste or have full authority from the owner to request its removal.
7.3 The Customer must not request the removal of any prohibited or unlawful Waste. If such Waste is discovered, the Company may refuse to remove it and may report any suspected illegal activity to the relevant authorities.
8.1 The Company operates in accordance with UK waste management legislation and holds or operates under all necessary licences or registrations required for waste collection.
8.2 The Company will transport and dispose of Waste at appropriately licensed or authorised facilities and will endeavour to maximise re-use and recycling where practicable.
8.3 Certain types of Waste cannot be collected under standard Services, including but not limited to:
a) Hazardous chemicals, solvents or liquids.
b) Asbestos or materials containing asbestos.
c) Clinical, medical or biological waste.
d) Pressurised gas bottles and cylinders.
e) Explosives, firearms, ammunition or similar items.
f) Radioactive materials.
8.4 If the Customer includes any prohibited items in the Waste without prior notice, the Company may:
a) Refuse to collect the prohibited items.
b) Charge additional fees for handling and arranging appropriate disposal, where lawful and possible.
c) Return the prohibited items to the Customer if already loaded, at the Customer’s cost.
8.5 The Customer remains legally responsible for any Waste presented for collection that is not lawfully permitted to be handled by the Company.
9.1 The Company will exercise reasonable care in providing the Services. However, minor scuffs or marks may occur where heavy or bulky items are removed from confined spaces. The Customer is responsible for taking reasonable steps to protect flooring, walls and fixtures where necessary.
9.2 The Company shall not be liable for any pre-existing damage or for any damage arising from inherent defects in the property or in items being removed.
9.3 The Company’s total liability for direct loss or damage arising from the Services, whether in contract, tort or otherwise, shall not exceed the total price paid or payable for the specific Booking giving rise to the claim.
9.4 The Company shall not be liable for any loss of profits, loss of business, loss of opportunity, consequential or indirect losses suffered by the Customer.
9.5 Nothing in these Terms and Conditions shall limit or exclude the Company’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded under UK law.
10.1 If the Customer is dissatisfied with any aspect of the Services, they should contact the Company as soon as possible, providing full details of the issue.
10.2 The Company will investigate all complaints in a fair and timely manner and will endeavour to reach a reasonable resolution, which may include re-attending the property, offering a partial refund or providing an explanation, depending on the circumstances.
11.1 The Company maintains appropriate insurance cover for its operations, including public liability insurance, in line with industry standards.
11.2 Details of the Company’s insurance cover are available on request. The existence of insurance does not extend or increase the Company’s liability beyond the terms set out in these Terms and Conditions.
12.1 Once the Waste has been loaded onto the Company’s vehicle and full payment has been made, title to the Waste transfers to the Company, subject to applicable law.
12.2 The Company reserves the right to sort, re-use, recycle, donate or dispose of collected Waste as it considers appropriate and in accordance with applicable regulations.
13.1 The Company shall not be liable for any delay or failure to perform its obligations where such delay or failure results from events or circumstances beyond its reasonable control. These may include, but are not limited to, extreme weather, traffic disruption, strikes, accidents, acts of terrorism, fire, flood, or changes in law or regulation.
13.2 In such circumstances, the Company may suspend the Services for the duration of the event or cancel the Booking without liability, but will endeavour to reschedule the Services where possible.
14.1 The Company will collect and process personal information from the Customer only as necessary to manage Bookings, provide the Services, issue invoices and administer the business.
14.2 The Company will handle personal information in accordance with applicable UK data protection legislation and will take reasonable steps to protect it against unauthorised access, loss or misuse.
14.3 The Customer agrees that the Company may contact them using the details provided in relation to current or future Services, service updates and legitimate business communications.
15.1 The Company reserves the right to update or amend these Terms and Conditions from time to time. Any changes will take effect when posted on the Company’s website or otherwise communicated to the Customer.
15.2 The version of the Terms and Conditions in force at the time of the Booking will apply to that Booking.
16.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of rubbish removal and waste collection services by the Company, shall be governed by and construed in accordance with the laws of England and Wales.
17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
